1. INTRODUCTION
1.1. These warranty terms and the other rules on the Website govern the warranty rules for services obtained from service providers registered on the platform provided by Vale24.com. Definitions are as follows: “vale24.com” refers to Vale 24 Inc.; “Website” refers to the website https://vale24.com; “User” refers to individuals who use the Website for any reason; “Service Recipient” refers to an individual or legal entity User who submits a Service Request via the Website; “Service Provider” refers to the individual, institution, or legal entity that creates a Professional Profile on the Website and approves the Member Service Provider agreement to provide services. If the Service Provider is a legal entity, this definition includes individuals carrying out services on behalf of and under the employment of the Service Provider. “Service Request” refers to a service request posted by the Service Recipient on the Website to receive offers from one or more Service Providers, or, depending on the nature of some services, the request for the Avokado system to direct services to the relevant Service Providers from among the Professional Profiles based on eligibility. “Offer” refers to the Service Provider's proposal to provide services for a certain amount in response to the Service Request sent by the Service Recipient. “Agreed Job” refers to the acceptance of the Offer sent through the System by the Service Providers by the Service Recipient via the System, or, for some services, the confirmation of the Service Request through the Reservation System. It is deemed that the User has accepted these terms upon the approval of the Service Request via the Website or from the moment they start benefiting from the Website, and commits to comply with these terms. Vale24.com reserves the right to unilaterally change or amend these terms, provided that it is not detrimental to the Users, in order to ensure the continuity of intermediary services, to address future technical necessities, or to comply with legislation. Vale24.com will publish the updated warranty terms on the Website under the same link with a new date update in case of any changes. The renewed and updated terms will become effective as soon as they are published on the Website. These warranty terms are directed at Service Recipients who have accepted the current user agreement and privacy agreement, and by having the Agreed Job performed, they are deemed to have accepted these warranty terms. Any changes to these warranty terms do not affect the validity of the remaining warranty terms or the user and privacy agreements on the site. Anyone with a registered customer profile on Vale24.com is eligible to benefit from the advantages provided under these warranty terms, provided that the necessary conditions are met, and within the limits of the amounts stated here.
2. WARRANTY DEFINITION
2.1. These warranty terms are established to cover the damages directly caused to the Service Recipients by third-party Service Providers, with whom an agreement was made through the selection of an Offer on Vale24.com, during the provision of the service (Agreed Job). The Service Recipient accepts in advance that the warranty terms are limited to the conditions specified in this policy. The scope of these warranty terms is limited to the repair or replacement of damaged goods and properties, or the coverage of medical expenses arising from physical injuries or disabilities of the claimant or third parties. All service applications by the Service Provider are guaranteed by Vale24.com, subject to the conditions specified below. Applications made before the announcement of these warranty terms, services provided by the Service Provider, applications outside the conditions specified in the warranty contract of Vale24.com, and services provided outside the Vale24.com platform by the Service Providers registered on the Vale24.com platform are not covered by the warranty.
3. WARRANTY PERIOD
3.1. The selected Offer on Vale24.com must be chosen within 15-30 days before the service begins and from the date of request. The damage to be claimed under warranty must occur within 6 months from the date the relevant Offer is selected, i.e., from the date the Agreed Job begins, and the situation must be reported to Vale24.com in writing within 72 hours after the damage occurs. Even if the Service Provider and the Service Recipient have been in communication, damages not reported to Vale24.com within 72 hours will be excluded from the compensation scope. The relevant service request that caused the damage to be claimed must have been made after February 1, 2017.
4. APPLICATION PROCESS
4.1. Service Recipients wishing to benefit from the warranty compensation must fill out the Warranty Information Form. The Warranty team will contact the applicant within 48 hours after receiving the form. The review process for the claim will be attempted to be completed within 1 month from the date the form is submitted. This process may vary, taking a shorter or longer time depending on the extent of the damage, the communication process with the user and service providers, the speed of this communication, and the documentation shared by the user regarding the damage.
5. CONDITIONS FOR BENEFITING FROM THE WARRANTY
5.1. The Service Recipient and the affected user must comply with the service receipt periods and conditions, application periods, and methods stated in this specification. To benefit from the warranty service, the Service Recipient must have a user account on Vale24.com. In the compensation claim, the Service Recipient must specify the details and the fee of the accepted Offer (Agreed Job). If the fee and appointment date have changed, the information must be updated on Vale24.com before the job begins. In cases where the Service Recipient does not update this information, the details in the original request form on Vale24.com are considered correct and complete and form the criteria for the job evaluated during the warranty process. Before making a damage compensation claim, the request must first be directed to the Service Provider, and the Service Recipient must have made every effort in the communication process with the Service Provider on this matter. If the damage suffered by the Service Recipient also constitutes an action defined as a crime under the Turkish Penal Code and other special penal laws, a criminal complaint must be filed with the police or prosecutor's office, and copies of documents such as the crime scene investigation report, complaint petition, and statement records, with the signatures of the relevant parties and officials, must be shared with Vale24.com. The Service Recipient requesting damage compensation must prove that they are the owner of the damaged goods or the representative of the related person and must share documents with Vale24.com that prove the value and damage of the goods and that the damage was directly caused by the Service Provider during the completion of the Agreed Job. For example, the invoice of the goods at the time of purchase or the repair invoice for the damage, photos, videos showing the damage, etc., may be requested by Vale24.com from the user. To assess or investigate the damage to be compensated, Vale24.com may send an expert or a specialist assigned by Vale24.com to the relevant Service Recipient, and the Service Recipient must allow such an inspection. If there is physical damage caused by the Service Provider during the performance of the service, and this physical damage has led to medical expenses, documents such as medical reports, medical imaging, laboratory, emergency room, medication, and hospital invoices related to the treatment of the physical damage must be shared with Vale24.com. If the Service Recipient with physical damage has covered some of these expenses with their private health insurance or general health insurances, Vale24.com is responsible only for the uncovered portion. Upon the request of Vale24.com, the Service Recipient who has suffered material or physical damage must file a lawsuit and/or a criminal complaint against the Service Provider and share the lawsuit and/or criminal complaint petition with Vale24.com. In such a case, Vale24.com may request to participate in (intervene in) the relevant case. This usually applies if communication with the Service Provider regarding compensation has broken down. If Vale24.com deems it appropriate to make a warranty payment, the Service Recipient requesting this must sign a Payment and Release Agreement with Vale24.com.
